HAS YOUR EMPLOYER BEEN PROFITING, TO YOUR DETRIMENT, FROM BREAKING THE LAW? IF SO, IT IS FUNDAMENTALLY UNFAIR TO CONTIUE TO ALLOW YOUR EMPLOYER TO INCREASE PROFITS WHILE AT THE SAME TIME DISRESPECTING YOU AND YOUR EMPLOYMENT RIGHTS.
Do you suspect that your current or former employer has been taking advantage of you? If so, please call The Tillmon Law Firm to discuss whether your employment rights are being violated.
The Tillmon Law Firm regularly handles cases involving the following issues:
- not being paid overtime pay – California law assumes that all employees are entitled to be paid at 1.5 times their regular rate of pay (known as "overtime wages", "overtime pay", or simply "OT") for all hours worked in excess of 8 per day or 40 per week;
- being paid on a salary basis and not receiving additional overtime wages when you work more than 8 hours in a day or over 40 hours in a week – It is extremely important to understand that just because you are called a “manager”, work on “commissions”, or are on a “salary”, none of these facts means that you are not entitled to overtime pay for any overtime hours you may work;
- employees not being allowed to take a completely duty-free 30-minute meal period before beginning their sixth hour of work for the day;
- employees not being allowed to take a second completely duty-free 30-minute meal period before beginning their eleventh hour of work when they work more than ten hours;
- employees not being allowed to take at least two completely duty-free 10-minute rest periods on each day they work anything more than six hours;
- employers taking tips away from employees or counting tips towards employees’ wages due;
- employees not being paid all of their wages immediately upon being fired, or within 72 hours of an employee’s voluntary resignation from employment.
The Tillmon Law Firm accepts employment law cases on a contingency fee basis. Under a contingency fee arrangement, the client NEVER owes any attorney fees unless and until a recovery is obtained in the case, at which time the attorney is paid a percentage of the money the attorney has recovered for the client.
